SkyborneDrop Privacy Policy
Last Updated: December 12, 2025
Skyborne Drop and Tech Investments LLC (operating as "SkyborneDrop," "we," "us," or "our") is committed to protecting the privacy and security of your Personal Data. This Privacy Policy describes how we collect, use, disclose, and otherwise process information relating to you, the individual user ("Customer," "you," or "your"), when you use our website, mobile application, virtual class services, and other offerings (collectively, the "Services").
By accessing or using our Services, you agree to the terms of this Privacy Policy and our Terms and Conditions of Service.1. Scope and Our Role as a Data Controller
1.1. Applicability
This policy applies to all Personal Data collected by us when you:
- Visit our website, www.skybornedrop.com, or use our mobile application.
- Purchase or use a subscription for virtual fitness classes (e.g., Yoga).
- Receive communications from us, including emails, SMS, or WhatsApp messages.
- Interact with us through third-party platforms (e.g., Zoom for classes, payment gateways).
1.2. Data Controller
For the purposes of the EU General Data Protection Regulation (GDPR) and equivalent global privacy laws, Skyborne Drop and Tech Investments LLC, based in Dubai, UAE, acts as the Data Controller for the Personal Data we collect directly from you to manage your subscription, process payments, and provide direct Services.
2. Personal Data We Collect
We collect information that identifies, relates to, describes, or is reasonably capable of being associated with you ("Personal Data").
2.1. Information Collected Directly from You
Contact & Identification Data: We collect your name, email address, phone number, mailing address, and date of birth. This data is used for account creation, billing, sending essential service notices, and for marketing communications (when you have given us consent).
Financial & Transaction Data: We collect payment card details (which are tokenized, meaning we do not store the full card number), subscription history, billing address, and transaction amounts. This information is necessary for processing payments, managing subscription renewals (which are non-refundable as per our T&C), and internal accounting.
Health & Wellness Data (Sensitive): We collect self-reported sensitive information such as medical conditions, recent injuries, physical limitations, or fitness goals provided during registration or class participation. This data is mandatory to provide safe instruction and modify classes, and is necessary to fulfill our duty of care, as acknowledged in the T&C.
Communication Data: We keep records of emails, SMS, or WhatsApp messages, and any feedback you provide. This helps us with customer support, resolving disputes, and quality assurance.
2.2. Information Collected Automatically
Usage & Technical Data: We automatically collect data like your IP address, browser type, device information, access times, pages viewed, time spent on the Site, and error logs. This is essential for maintaining security, detecting fraud, improving website performance, and debugging.
Class Interaction Data: We track your attendance records, class completion status, and time spent in virtual sessions (via API integration with platforms like Zoom). This is used for tracking subscription usage, performance metrics, and fulfilling our contractual obligations.
3. How We Use Your Personal Data (Legal Basis)
We process your Personal Data based on the following legal grounds:
Contractual Necessity: We process your data to fulfill our obligations under the Terms and Conditions. This includes processing payments, granting you access to classes, and providing customer support.
Legitimate Interests: We rely on this basis for business purposes such as security monitoring, fraud prevention, service improvement, technical maintenance, and analyzing usage trends to develop new offerings.
Consent: We use consent for sending you marketing communications (email, SMS, WhatsApp) where required by law, and specifically for the processing of Sensitive Health Data to provide appropriate class modifications. You may withdraw this consent at any time.
Legal Obligation: We process data to comply with legal requirements, tax reporting obligations, or respond to lawful requests by public authorities in Dubai, UAE, or other applicable jurisdictions.
4. Disclosure and Sharing of Personal Data
We share your Personal Data only in limited circumstances and only as necessary to provide the Services:
With Third-Party Service Providers: We share data with vendors who perform functions on our behalf. This includes Payment Processors (to handle subscription billing), Virtual Class Platforms (e.g., Zoom, to facilitate your access to live classes), and IT and Hosting Providers (to store Customer Data securely).
With Our Trainers/Instructors: We share necessary Name/Screen Name and limited Health/Wellness Data with the specific instructor teaching your class, strictly for the purpose of ensuring your safety and tailoring instruction.
Affiliates: We may share data with our current or future Affiliates (as defined in the T&C) for internal administration and service continuity.
Legal Compliance: We may disclose your data if required by Law, subpoena, or if we believe in good faith that such action is necessary to comply with the law or protect our rights.
5. Cross-Border Data Transfer (Global Markets)
SkyborneDrop is based in the UAE, but our Services are global. Your Personal Data will be processed and stored in the UAE and potentially in other jurisdictions where our third-party service providers are located (e.g., USA for cloud hosting or Zoom).
By using the Services and providing your Personal Data, you explicitly consent to the transfer of your Personal Data outside of your country of residence, including to the UAE, where data protection laws may differ from those in your jurisdiction (such as the EU or UK). We implement appropriate safeguards, such as contractual clauses, to ensure your data remains protected.
6. Security and Retention
6.1. Security
We employ commercially reasonable administrative, technical, and physical safeguards to protect Personal Data from unauthorized access, use, or disclosure. However, no security system is impenetrable, and we cannot guarantee the absolute security of your data.
6.2. Retention
We retain your Personal Data for as long as your account is active, or as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law (e.g., financial records are kept for a minimum of five years).
7. Your Privacy Rights (Simplified)
We respect your rights over your personal information. Depending on where you live (such as the EU/GDPR or California/CCPA), you have the right to ask us to take certain actions regarding your data. All requests should be sent to the email address listed in Section 8.
Review Your Data (Right to Access): You can ask for a copy of the specific personal data we hold about you.
Correct Your Data (Right to Rectification): You can ask us to fix or complete any personal data about you that is inaccurate or incomplete.
Delete Your Data (Right to Erasure): You can ask us to delete your personal data. We will do this unless we are legally required to keep it (e.g., for tax or financial records).
Stop Marketing & Limit Use (Right to Opt-Out): You can object to us processing your data for marketing purposes. You can also ask us to temporarily limit how we use your data.
Get Your Data (Right to Portability): You can request your personal data in a common electronic format so you can transfer it elsewhere.
Withdraw Consent (Data Only): If we relied on your explicit permission (consent) to use your data (like for marketing communications or sensitive health data), you can take that permission back at any time.
Important Note on Subscription Cancellation
Your right to manage your data (listed above) is separate from your right to cancel your financial subscription. To cancel your recurring fitness subscription, you must follow the procedures outlined in our Terms and Conditions of Service (T&C), particularly regarding the non-refundable nature of fees (T&C Section 3.2). Canceling your subscription does not automatically delete all retained legal and financial data.
Marketing Opt-Out
You can easily stop receiving promotional emails by clicking the "unsubscribe" link at the bottom of any marketing email you receive from us.
